Welcome to the Health Connective Telegram Chat Group (the “Group”)!
By accessing and participating in the Group, you are deemed to have reviewed and accepted these Terms of Use (“TOU”) and any other posted guidelines or rules applicable to the Group ("guidelines") which may be posted on the Health Connective website (https://www.healthconnective.sg/) or through the Group from time to time as a condition to your access and participation in the Group. All such guidelines shall be considered part of the TOU. If you do not agree to the TOU and/or the guidelines, please refrain from participating in the Group.
Health Connective reserves the right to modify any or all of the terms and conditions in the TOU (including the guidelines) at any time without notice to you. You can review the most current version of the TOU at any time at: https://www.healthconnective.sg/termsofuse. Your continued access to and participation in the Group shall constitute your consent to the modified TOU.
Health Connective is a collaborative platform dedicated to transforming communication and coordination between key stakeholders of the private healthcare ecosystem so that everyone can focus on what they do best - for the benefit of those we care for. This Group serves as a channel for you to communicate with fellow family physicians and specialist doctors who are part of the Health Connective community.
The Group is open to participation by medical professionals and clinicians, who have expressly opted in through the Health Connective website. Health Connective reserves the right to discontinue participation of any individual at any time, at its sole discretion, if it is found that the individual has provided false information or is deemed ineligible or unsuitable to participate in the Group.
You will be added to the Group using the Telegram account and/or associated mobile number that you have registered with your Telegram account. You may choose to ‘quit’ or ‘exit’ by leaving the Group at any time, should you choose to do so.
By accessing, joining and/or participating in the Group, you acknowledge and consent to Health Connective and other participants having access to your mobile phone number/ personal contact number, Telegram profile picture and any other information accessible through Telegram or the Group. If you do not wish for Health Connective and/or other participants to receive or have access to such information, please refrain from joining, accessing, or participating in the Group.
You shall access the Group solely through your Telegram account and are responsible for all actions relating to your access to and participation in the Group using your Telegram account. Health Connective has no obligation to verify the authenticity of any communications made on or through the Group via your Telegram account, nor to confirm the identity of any person accessing, managing or using your Telegram account. You agree that Health Connective may act upon, rely on, and hold you responsible and liable for any communications, messages, or actions taken through your Telegram account, as if they were executed by you personally. In the event of any unauthorized use of your Telegram account or any other Telegram account and/or associated mobile number that you employ, you shall immediately notify Health Connective of such unauthorized use.
Health Connective reserves the right to take any and all appropriate measures to safeguard the integrity of the Group, including but not limited to suspending or terminating access for any user who is suspected of engaging in unauthorized use or activities.
Your access to and participation in the Group may require, enable, provide, or facilitate access to or use of the websites, software or services offered by third parties (“Third Party Services”). In such instances, there may be additional terms governing your access to and use of such Third-Party Services (the “Third Party Terms”) which may be binding upon you, Health Connective or both parties. When you use any Third Party Services, the applicable Third-Party Terms will govern your use of the same. It is your sole responsibility to review and understand the most up-to-date versions of all applicable Third-Party Terms, and you agree that such terms shall apply to your use of those services.
Health Connective does not endorse, and is not responsible or liable for, any Third-Party Services or the content, products, or services provided therein. By using or accessing Third Party Services, you acknowledge that you are doing so at your own risk and that Health Connective shall not be held liable for any damages, losses, or inconveniences arising from your use of such services, including any violation of Third-Party Terms.
All information, data, text, sound, photographs, graphics, video, messages, materials or other content ("Content") available or transmitted in or through the Group are the sole responsibility of the person from which such Content originated. You acknowledge and agree that you, and not Health Connective, are entirely responsible for all Content that you post, transmit, or otherwise make available via the Group. You shall be responsible for all Content posted, uploaded, transmitted, or otherwise made available via the Group utilizing your Telegram account, regardless of whether such access is executed by you or another individual..
Health Connective does not control, review or pre-screen any Content posted or transmitted in or through the Group and, as such, does not guarantee the accuracy, integrity or quality of such Content. You acknowledge that by joining, accessing and/or participating in the Group, you may be exposed to Content that may be offensive, indecent or objectionable.
Under no circumstances will Health Connective be liable in any way for any Content, including, without limitation, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of any person's access to or use of any Content posted, transmitted or otherwise made available via the Group. You are solely responsible for evaluating and bearing all risks associated with your access to and use of any Content, including any reliance you may place on the accuracy, completeness, or usefulness of such Content. Any reliance on such Content is undertaken at your own risk. (See the Disclaimer of Warranties and Exclusion of Liability clauses below.)
You shall not use the Group to, or when accessing or participating in the Group, shall not:
• upload, post, transmit or otherwise make available any Content that:
o is or may be unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, threatening, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, religiously, ethnically or otherwise offensive or objectionable, or is irrelevant to Health Connective's purposes or the existing/ ongoing discussion(s). Health Connective has the sole discretion to decide if any Content falls within these said categories;
o infringes any patent, trademark, trade secret, copyright or other intellectual property rights of any party, or for which you do not possess the requisite rights to publish or otherwise disseminate under any applicable law or contractual obligation;
o contains any unsolicited or unauthorised advertising and promotional materials, including but not limited to surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages;
o contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of Telegram, any computer software or hardware or telecommunications equipment;
o repeats any Content in its exact form which you had previously uploaded, posted, emailed or transmitted on or through the Group; or
o reproduces Content created by parties other than yourself without proper authorization or consent;
o use or create a false identity (including but not limited to, use of a pseudonym, impersonation of any person or entity, or otherwise referring to yourself using descriptive word/s or word/s which do not appear to us to be your actual name or derived from your actual name), or falsely state or otherwise represent your affiliation with a person or entity, or use any identity or name which is not in compliance with any policy that Telegram may have in relation to use of names;
o do anything which may be disruptive to other participants’ engagement in the discussion, dialogue or other exchange in the Group, or otherwise act in a manner that negatively/adversely affects other participants' user experience and/or ability to engage in real time exchanges;
o threaten, stalk or otherwise harass any other participant or any person employed by Health Connective;
o restrict or inhibit any other participant from accessing or participating in the Group;
o do anything which could interfere with, disrupt, disable, overburden or impair the proper functioning or appearance of the Group or Telegram, or the servers or networks connected to the Group or Telegram;
o disobey any requirements, procedures, policies or regulations of networks connected to Telegram;
o collect, store, transmit, disclose, publish or use, for any purpose whatsoever, the personal data of any other participant or any Content transmitted or posted via the Group, or invite any other participant to disclose his/her personal data to you or to any third party, whether such disclosure is made on the Group or through Telegram or in any other way;
o disclose your contact information, or the contact information of any other person, on or through the Group or Telegram;
o access or participate in the Group using the Telegram account or mobile number of any other person; or
o violate any applicable laws or regulations.
Health Connective reserves the right to disallow and request for the removal of any Content at its sole discretion, in particular any Content that, in Health Connective's view, violates any of the terms of the TOU. In the event you receive a request for removal of Content, you must proceed to remove the Content in question within 15 minutes from the time of such request or while the Content is still removable within the Telegram one-hour timeframe, whichever is shorter. Health Connective is under no obligation to disclose the reasons and the circumstances leading to the request for removal.
Health Connective reserves the right to preserve all or such part of the Content as it deems appropriate, and may disclose all or any part of the Content to any person or organization/entity if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOU against any person; (c) investigate and respond to claims that any Content violates the legal rights of any party; or (d) protect the legal rights, property, and/or personal safety of any party.
Health Connective does not claim ownership of the Content you transmit, post or otherwise make available in or through the Group. However, with respect to such, you grant Health Connective, its employees and partners, a world-wide, royalty free, irrevocable and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content (or any part thereof). This license includes the right to use such Content (or any part thereof) in any publicity materials for the Group, in any medium (including the mass media, internet posts, e-mail communications and so on). To the extent that any rights of attribution and integrity or other moral rights apply to any Content transmitted, posted or otherwise made available by you, you hereby irrevocably waive and agree not to enforce such rights against Health Connective, any of its employees and/or partners.
All data and information collected by Health Connective about you as a result of your participation in the Group are governed by our Privacy Policy. For more information, please refer to our full Privacy Policy. Health Connective reserves the right to amend the Privacy Policy at its sole discretion from time to time without prior notice. The latest version of the Privacy Policy will be posted on the Health Connective website.
In consideration for your access and participation in the Group, you agree to fully indemnify, defend and hold harmless Health Connective, its employees and partners from and against any and all claims (including third party claims), demands, losses, liabilities, costs and expenses (including but not limited to legal costs and expenses on a full indemnity basis) arising directly or indirectly from your access to or participation in the Group, including any Content you transmit, post, or otherwise make available therein, your breach of any terms set forth in the TOU, or your violation of any rights of any third party in connection with your access to or participation in the Group.
Health Connective shall bear no responsibility or liability for the deletion of or the decision not to store any messages and other communications or other Content maintained, posted or transmitted in or through the Group. You acknowledge that Health Connective may change its general practices and limits at any time, at its sole discretion, without notice.
Health Connective reserves the right to modify, delete, remove or discontinue the Group, whether temporarily or permanently, without notice. Health Connective shall not be liable to you or to any third party for any modification, deletion, removal, suspension or discontinuance of the Group.
Health Connective may, at its sole discretion, block or otherwise terminate your access to the Group without notice and without any obligation to disclose the reasons for such termination under any of the following circumstances: (a) your breach of any of the terms of the TOU , (b) pursuant to a request by a law enforcement or other government agency, (c) pursuant to a request by you, (d) as a result of Health Connective's decision to delete, remove, discontinue or modify the Group, (e) as a result of technical issues or problems with or relating to Telegram or the Group, and/or if (f) you have been inactive or have otherwise ceased to participate in the Group or any of its features, for a prolonged duration.
Health Connective retains the sole discretion to determine whether any of the above circumstances exist, and whether to block or terminate your access accordingly. Health Connective shall not be liable to you or any other party for any termination of your access to the Group.
Health Connective may transmit or post links to third party websites or resources not maintained by Health Connective (the "links") in or through the Group.
Health Connective reserves the right to remove, replace or disable any such links at its absolute discretion (though it is not compelled to do so), particularly if those links are connected to websites or resources containing material or information that, in the opinion of Health Connective, infringes the TOU in any way.
Health Connective is not responsible for the availability of the websites or resources connected with the links ("the linked websites"), and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from the linked websites. Health Connective shall not be liable to you or any other party for any damage or loss whatsoever, including but not limited to, loss of goodwill, profits, lost or corrupted or damaged Content, or damage to your computer, software or other property, arising directly or indirectly from access to the linked websites, or the removal of any links.
Notices to you may be made via WhatsApp, SMS, Telegram, email or postal mail. Health Connective may also (but is under no obligation to) provide notices of changes to the TOU or other matters by posting such notices or links to the same on the Health Connective website or through the Group.
Health Connective makes no representations or warranties in respect of the Group. All express, implied, and statutory warranties, including without limitation, the warranties of fitness for a particular purpose and non-infringement of proprietary rights, are expressly disclaimed to the fullest extent permitted by law.
Health Connective disclaims any and all responsibility or liability for any Content available or transmitted in or through the Group, including the accuracy, completeness, legality, reliability, operability or availability of such Content.
Under no circumstances shall Health Connective be liable to you for any damages arising from your access to and participation in, or reliance on, the Group or any Content transmitted or posted in or through the Group. This exclusion of liability applies whether such damages arise from unauthorized access to the Group, misuse of the Group or Content, inability to access or join the Group, the acts of any other party (including participants), or from the interruption, suspension, or termination of the Group.
Your access to and participation in the Group and any questions or disputes arising from such access and participation or the TOU shall be governed by and construed in accordance with the laws of the Republic of Singapore. You agree to submit to the exclusive jurisdiction of the Singapore courts for the resolution of any such disputes.
